Our Contract

We must receive payment of the full price of the goods that you order before your order will be accepted. Once payment has been received we will confirm the order by email (provided in your order form). This brings into existence a legally binding contract between us.

Rights

All rights, including copyright, on this website are owned by or licensed to Spinadisc Records Limited. Any use of this website or its contents is prohibited unless for your own personal, non-commercial use.

Accuracy of content

All product descriptions and prices have been prepared and presented with the utmost care and attention to detail. We make every effort to ensure that prices quoted are correct at the time of publishing and that goods are described accurately. Orders will only be accepted if there is no false or misleading information in the description of the goods or their prices as advertised on this website.

Acknowledgement and acceptance of your order

We will notify you by e-mail as soon as possible to confirm receipt of your order and e-mail you again to confirm details. An acceptance of your order will take place on despatch of the goods ordered.

Price

The prices on our website are the prices payable and are inclusive of VAT at the prevailing rate. Wherever it is not possible to accept your order to buy specific goods at the price indicated we will advise you by email, and offer you the new price in this email.

Availability

All orders are subject to acceptance and availability - if the Goods in your order are not in stock we will let you know by email and you can then choose to wait for a delayed delivery or to cancel the order at no charge to you.

Ordering errors

You are liable for any costs arising from errors you make on your order – you are able to amend orders within the website up to the point at which you press “submit” during this process.

Payment terms

We accept only immediate payment terms. We accept no liability if a delivery is delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the goods from your stated payment method then we can cancel the contract and / or suspend any further deliveries to you. This does not affect any other rights we may have.

Delivery charges

All applicable delivery charges are stated on our website. Where a different service is required please contact us to discuss – we reserve the right to refuse to ship to certain countries or territories, we reserve the right to only offer certain and specific shipping options.

We will confirm delivery charges in our confirmation email sent to you after you place your order. In this email we will also confirm the delivery address you have given us in your order – it is important that you give us clear and accurate delivery details. If you do not receive an email please check your spam folder and make sure you mark simon@spinadisc.co.uk and mark@spinadisc.co.uk as safe email addresses.

We do not accept any liability for any loss or damage to the goods once they have been delivered unless caused by our negligence. Delivery times are advisory and not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, we will update your delivery date in an email.

You will become the owner of the goods when they have been delivered to you. The goods are then held at your own risk and we will not be liable for their loss or destruction.

All faulty records can be refunded upon return and customers will be reimbursed with postage if agreed beforehand.

Cancellation rights, Returns and Refunds

Spinadisc Records Limited adheres to the Consumer Contracts Regulations which dictate your rights as a consumer of products purchased online and our responsibilities as an online seller. A full breakdown of these Regulations can be obtained from this link.

Cancellation by us

We reserve the right to cancel the contract between us if we no longer have the stock to deliver the goods you have ordered; we are unable to deliver to your area; we have made a typographical error or if there has been an error in the pricing information received by us from our suppliers.

If we cancel your contract we will notify you by e-mail and will re-credit any sum deducted by us from your credit card as soon as possible and within 28 days of your order.

Liability

If we have not delivered goods to you within 28 days of order (or 28 days of release date in the case of pre-ordered products that have not been released at the point of order) we will have no liability to you unless you write to us within 60 days of your order date. We will then either make good any shortage or non-delivery; replace any goods that are damaged or defective; refund to you the amount paid by you for the goods in question.

Both parties shall only be liable under this contract for losses, which are a reasonably foreseeable consequence of the relevant breach of contract.

You must observe and comply with all applicable regulations and legislation. We make no representation and accept no liability in respect of the export or import of the goods you purchase. Nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights.

Notices

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address at 50 Perry Street, Northampton NN1 4HW.

Changes to legal notices

We reserve the right to change these terms and conditions as required in the operation of our business.

Law, jurisdiction and language

This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

You acknowledge and agree to be bound by the terms of our privacy policy.

Spinadisc Records Limited understands the importance of safeguarding and preserving the privacy of our customers, clients, partners and staff. We operate in accordance with prevailing GDPR legislation – please see this link for full description of your rights and our obligations.

As a small business both directors take responsibility for the careful management of data. We have specified electronic systems in our website to ensure that data is stored securely and only used strictly in accordance with GDPR guidelines. Should the UK adopt new regulations following Brexit we will continue to maintain the highest standards of privacy and will update our policy.

Information that we collect and process may include: details of your visits to our website and the pages you access; any information collated from web-forms or information provided to make a purchase; information provided to us when you communicate with us for any reason.

The information we hold for our customers enables us to provide our service to you. We also use to provide product / company information and updates where requested and relevant.
